    North East Derbyshire District Council is considering introducing a Public SpacesProtection Order (PSPO) to help tackle anti-social behaviour in Mill Lane, Stainsby and thesurrounding rural areas. PSPOs are powers available to local authorities under the Anti-Social Behaviour, Crime and Policing Act 2014, designed to address activities that have adetrimental effect on the quality of life for those in a particular area. This PSPO proposalrecognises that Mill Lane and its surroundings are not only home to local residents, but arealso frequented by landowners, businesses, and a wide range of visitors—including thoseenjoying local attractions such as Hardwick Hall and Stainsby Mill. Anti-social behaviour inthis rural setting can impact everyone who lives in, works in, owns land in, or visits the area.

    Before making any decision, the Council is seeking views from all those affected:residents, landowners, businesses, and visitors. Your feedback will help us understand theextent of the issues and shape the measures we take to keep Mill Lane, Stainsby and its surroundings safe and welcoming for all.

Public Spaces Protection Orders (PSPOs) are powers introduced by local authorities(under the Anti-Social Behaviour, Crime and Policing Act 2014) to help deal with aparticular nuisance or problem in a particular area that is damaging to the localcommunity's quality of life.Public Spaces Protection Orders (PSPOs) are intended to deal with nuisance or problemsin an area that cause harm to the quality of life of the local community.The power to make a Public Spaces Protection Order was given to District Councils by theAnti-Social Behaviour, Crime and Policing Act 2014.Before making an order, the council must consult with the local chief officer of police, andthe local policing body, community representatives and the owner or occupier of landwithin the restricted area. The Council must also notify the County Council and Parish(Town) Council of the proposed order.

What is a PSPO - The Council can make a PSPO on any public space within the area if it is satisfied that theactivities carried out, or likely to be carried out, in a public space:1) Have had, or are likely to have, a detrimental effect on the quality of life of those in thelocality.2) Is, or is likely to be, persistent or continuing in nature.3) Is, or is likely to be, unreasonable.4) Justifies the restrictions imposed.The PSPO can prohibit people from doing certain things in an area, requires specifiedthings to be done by persons carrying out specified activities in an area, or do both ofthose things.A PSPO can last for up to three years but this time period can be extended if necessary.
